Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition has been filed by one of the accused in Case Crime No. 151 of 2019, P.S. Banna Devi, District- Aligarh for a direction to conclude the investigation after recording statement of the respondent no.4.
The respondent no.4 is stated to be mother of the informant.
It is well settled principle that an accused cannot force the investigation agency to record statement of such persons who may be favourable to the accused though it is expected that the investigating agency would carry out investigation with a view to find out the truth.
Under the circumstances, the prayer of the petitioner as framed cannot be accepted though it is expected that the investigating agency would conclude the investigation as per law.
