Heard Mr. Satya Priya Mishra, learned counsel for the applicants and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed challenging the summoning order dated 12.09.2013 passed by the Additional Chief Judicial Magistrate-4, Gorakhpur in Complaint Case No. 313 of 2013 ( Ramji Vs. Bhola and others) under Sections 467, 468, 471, 504 and 506 I.P.C., Police Station-Pipraich, District-Gorakhpur as well as the entire proceedings of the above mentioned complaint case.
From the perusal of the order sheet, copy of which is on the record as Annexure-4 to the affidavit, it is apparent that the summoning order was passed by the court below on 12.09.2013. When inspite of issuance of the summons, the applicants did not appear before the court below, the court below issued bailable warrants vide order dated 15.10.2014. When inspite of the aforesaid, the applicants did not appear before the court below, the non-bailable warrants were issued against the applicants vide order dated 03.07.2015. Thus, the non-bailable warrants issued by the court below against the applicants have been operating for the last more than three years but inspite of the expiry of the aforesaid period, the applicants have not appeared before the court below. This shows total disrespect to the process of the Court.
On the facts as noted herein above, no occasion arises before this Court to entertain this application.
It is accordingly dismissed.
