1. Mr.
Alkesh Shah, learned Assistant Government Pleader places on record communication dated 4.2.2012 addressed to Superintending Engineer, R & B Circle-II, Rajkot by Executive Engineer, R & B Division, Junagadh along with photocopy of cheque dated 4.2.2012. The said communication along with photocopy of cheque dated 4.2.2012 is taken on record. Under instructions received from Mr. Suresh Raval, Under Secretary to the Government of Gujarat, R & B Department, Gandhinagar, Mr. Shah,learned AGP. states that a cheque of Rs.1,50,000/- has been issued in favour of the present petitioner on 4.2.2012 and the same is received by the petitioner.
2. In view of the above, Mr.I.S. Supehia, learned Counsel for the petitioner does not press this petition at this stage and seeks permission to withdraw the petition. Permission granted. The petition stands disposed of as withdrawn. Notice discharged with no order as to costs. It goes without saying that as stated in the communication dated 4.2.2012, the respondent authority shall make further payment as indicated in the said communication.
