Heard learned advocate for the applicants and learned Additional Public Prosecutor for the State.
2. Following aspects are considered :-
(i) The applicants are facing charges for the offence punishable under Sections 306 and 114 of IPC;
(ii) There has been dispute between the deceased and the applicants on account of lands and which resulted into frequent quarrels, which, in turn, led the deceased to commit suicide;
(iii)There is no material to show direct abetment of suicide at the hands of the applicants at this stage.
(iv) No criminal antecedents.
3. Considering the above aspects, the application deserves to be allowed and the same is allowed. The applicants are ordered to be released on bail in connection with Crime Register No. I-49 of 2010 of Vartej Police Station on their executing a bond of Rs.10,000/- (Rupees ten thousand only) each with one surety each of the like amount to the satisfaction of the lower Court subject to such conditions which the lower Court may deem fit to impose.
4. Rule is made absolute.
5. Direct service is permitted.
