JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Heard learned senior advocate Mr.Percy Kavina appearing with learned advocate Ms.Mamta R. Vyas for the appellants. The learned senior advocate states that he is trying to persuade his client to buy peace in the matter by finding out an amicable solution to the matter which may be in the form of paying amount to the respondent-teacher, which may be on the basis of the shortfall of the amount earned by him during this period in comparison to the amount he would have earned while working as teacher with the appellant-school.
Besides, the learned senior advocate for the appellants submitted that the Special Leave Petition filed before the Hon'ble the Apex Court is pursued and he is hopeful that the same may be heard at the earliest.
2. Party-in-person, Yogeshbhai Ambalal Patel states that there is non compliance of the order passed by this Court. Not only that the amount of cost which was ordered by the Hon'ble Tribunal in the year 2006 is also not paid. He requests that there should be immediate compliance of the order passed by this Court.
The party-in-person further states that the calculation submitted by the appellants is not correct according to him and that he may file necessary affidavit for placing his own calculation.
3. As the matter is already carried up to the Hon'ble the Apex Court it is deemed proper to grant time to the appellants to enable them to explore possibility of an amicable settlement of the matter and simultaneously if they are not successful in that, to pursue the SLP before the Hon'ble the Apex Court.
Adjourned to 17th February 2012 as requested by the learned senior advocate.
