JUDGMENT / ORDER

Board shows that the Rule is not received back for respondent No.2.
This application is preferred by the applicant to condone the delay of 138 days in filing main Revision Application.
Learned advocate for the applicant submitted that the Family Court issued warrant against the respondent, but he did not appear before the Family Court and simply affidavit of the respondent was produced through Ekdil Police Station of District : Itavah (U.P.). Learned advocate further submitted that present applicant has tried to serve, but she could not serve. Even before the Hon'ble Supreme Court, Special Leave Petition was filed and same was dismissed. He submitted that the Rule is required to be served to respondent No.2. He also submitted that the conduct of the respondent shows that he is avoiding service of Rule.
Heard learned APP Mr. Jani for the State.
Perused the application and record of the case. Here in this case, the question of maintenance towards wife is involved and the Hon'ble Supreme Court dismissed the Special Leave Petition filed by the respondent No.2. In view of the above situation, office is directed to issue Fresh Notice of Rule to respondent No.2, returnable on 12.6.2012 to be served through SSP of Itavah District (U.P.) (Z.K.SAIYED,J.) ynvyas Top
