1.0. Present Second Appeal under Section 100 of the Code of Civil Procedure has been preferred by the appellant-husband challenging the impugned judgment and decree passed by the learned 2nd Additional Senior Civil Judge, Surendranagar passed in HMP No. 41 of 1998 by which the learned trial Court has dismissed the said petition filed by the appellant-husband for getting divorce as well as impugned judgment and order passed by the learned trial Court dated 27.11.2011 passed in Regular Civil Appeal No.55 of 2007 dismissing the said appeal confirming the judgment and decree passed by the learned trial Court dismissing the HMP No.41 of 1998.
2.0. Today, when the present appeal is taken up for hearing, learned advocate for the appellant seeks permission to withdraw the present Second Appeal. Permission is, accordingly granted. Appeal is dismissed as withdrawn unconditionally.
