Heard Sri Rajesh Kumar Tiwari holding bring of Sri Om Prakash Pandey, learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.
The sole relief pressed by the petitioner is that the objection/application dated 26.6.2020 filed by him in Case No.85/33 (State vs. Dinesh Pratap Narayan Singh) under section 11(2) of the U.P. Imposition of Ceiling on Land Holdings Act, 1960 pending in the Court of Prescribed Authority/Additional District Ceiling Officer, District Kushi Nagar be decided expeditiously.
Learned Standing Counsel appears for respondent nos.1 to 3. In view of the order that is proposed to be passed, it is not necessary to issue notice to the private party.
Without going into the merits of the case, it is directed that the objection/application dated 26.6.2020 filed by the petitioner in Case No.85/33 (State vs. Dinesh Pratap Narayan Singh) be decided within a period of four months from the date of presentation of a copy of this order, if there is no other legal impediment. It is further provided that if any application for interim relief is pending, then order shall be passed on it within a period of two weeks. For a period of two weeks or till the decision of the application for interim relief, whichever is earlier, no eviction shall take place. The copy of this order shall be duly certified by the learned counsel for the petitioner.
The writ petition is, accordingly, disposed of.
