Heard learned counsel for the petitioner and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"I). Issue suitable direction to Court of Civil Judge (Senior Division) F.T.C. Rama Bai Nagar (Kanpur Dehat) to decide the Original Suit No.
319 of 2012 (Bharat Singh Chauhan vs. Randhir Singh and others) pending for final disposal of application 6-C filed under Order 39 Rule 1 & 2 of C.P.C. sought for permanent injunction regarding the house in question situated at Village Arya Nagar First, Fatehpur Roshanai, Tehsil Akbarpur, District Rama Bai Nagar pending before the learned Civil Judge (Senior Division) F.T.C. Rama Bai Nagar (Kanpur Dehat) within stipulated period as fixed by this Hon'ble Court."
Accordingly, this petition is disposed of with a direction to the court concerned to consider and decide the aforesaid 6-C) application of the petitioner filed under Order 39 Rule 1 & 2 of Code of Civil Procedure, 1908 pending in O.S. No.- 319 of 2012 strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months from the date of production of copy of this order.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
