Heard Sri Hanuman Prasad Dube, learned counsel for the petitioner, Sri Archana Singh, learned counsel appearing for the respondent Nos. 2, 3 and 4 and perused the record.
By means of this petition, the petitioner has challenged the advertisement dated 25th November, 2018 on the ground of it to be in violation of the brochure issued by the respondents themselves dated 24th November, 2018.
Ms. Archana Singh, learned counsel for the respondent informs the Court that the selection against the outlet of regular OBC candidate Sri Anoop Bhatnagar has taken place and in view of that the selected candidate is the necessary party and the writ petition is also liable to be dismissed for non-joinder of the necessary parties.
We find that the advertisement was made way back on 25th November, 2018 and we do not see any justification as to why the petitioner has sat silent for so many months and has come up now to file this writ petition challenging the advertisement.
Besides petition being not entertainable as the person selected has not been arrayed as respondent, we are not inclined to interfere with the advertisement at such a belated stage and the petition is clearly barred by latches.
The writ petition lacks merit and is, accordingly, dismissed.
