Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
Present writ petition has been filed seeking a direction to the Sub- Divisional Magistrate, Tehsil Bara, district Prayagraj/respondent no. 1 to decide the stay application in Partition Suit No. T20150203071476 (Hanuman Prasad Singh Vs. Dwarika Prasad Singh & another) filed by the plaintiff/petitioner under Section 176 of the U.P. Zamindari Abolition and Land Reforms Act, 1950 within a stipulated period.
A perusal of the order-sheet reflects that on most of the dates lawyers are not working. This reflects a sorry state of affairs.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Sub-Divisional Magistrate, Tehsil Bara, district Prayagraj/respondent no. 1 to expedite the hearing of the aforesaid application and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of nine months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties and provided the functioning of the authority concerned is not affected due to any reason related to Covid-19 Pandemic as well as the lawyers are not abstaining from the judicial work.
With the aforesaid observations/ directions, the present petition is finally disposed of.
No costs.
