(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned Senior Counsel, Mr.Yatin Oza for the appellant states that new premises is now ready since long and it matches with all the requirements. It is also submitted that if inspection of new premises is made, the authority can satisfy itself that the appellant is fulfilling all the requirements.

We are making returnable date earlier in view of the arguments of the appellant that if the students are allotted to other Institutions, the appellant will suffer immensely.
The interim prayer asked for by the appellant will be considered after hearing both the sides on the next date. Meanwhile, it will be open for respondent No.1 to inspect the premises if it is possible and inform the Court about the existing status of the new premises constructed by the appellant.
The question about allotting the students will be considered after hearing both the sides. Direct service is permitted. Over and above the same, the Registry is directed to communicate this order by fax message to respondent Nos.1 and 2, at the cost of appellant.
