JUDGMENT / ORDER

Learned advocate Mr.Virat Popat seeks permission to file vakalatnama on behalf of original complainant. Permission is granted.
Learned advocate for the applicant submits that previously application for anticipatory bail is withdrawn before this Court and because of change in circumstances, this application is preferred again praying for anticipatory bail. He took this Court through the complaint and submitted that no offence is made out and no explanation has been given for the delay caused in filing the complaint.
Learned APP Mr.Dabhi submitted that previously the present applicant preferred anticipatory bail application which has been withdrawn unconditionally and so question does not arise to entertain this application.
The order was passed in Criminal Miscellaneous Application No.264 of 2012 on 14.02.2012 wherein the other accused was granted anticipatory bail whereas the anticipatory bail application was withdrawn qua the present applicant.
Considering the fact that withdrawal of the application qua the present applicant amounts to rejection and so question does not arise to again decide the anticipatory bail application of the present applicant on merits. In view of the above, this application is rejected.
