Heard the counsel for the petitioner.
The present writ petition has been filed against the order dated 12.6.2019 passed by the Deputy Director of Consolidation, Sambhal.
The grievance of the petitioner against the aforesaid order is that the Deputy Director of Consolidation has withdrawn the Chak allotted to the petitioner on his original holding i.e. Plot No.154 without considering the case of the petitioner and the hardship that would be caused to him.
The matter requires consideration.
Issue notice by registered post with acknowledgement due to the respondent nos. 2 to 4 for which steps shall be taken by the petitioner within 10 days from today.
In case, steps as aforesaid are taken by the petitioner, the office shall issue notice to the respondents fixing any date in the 3rd week of November 2019 by which date the respondents may file their counter affidavit. Petitioners shall have four weeks thereafter to file their rejoinder affidavit.
List after expiry of the aforesaid period.
On failure of the petitioner to take steps as aforesaid, the case shall be listed after ten days under Chapter 12 Rule IV of the Allahabad High Court Rules, 1952.
Meanwhile, parties shall maintain status quo regarding the disputed plots.
