The present bail application has been filed by the applicant in S.T. No. 18/2018 in Case Crime No. 591/2017, u/s 498A, 304B, 318 IPC and 3/4 D.P. Act, P.S. Jaswant Nagar, District Etawah with the prayer for enlarging him on bail.
Having heard Sri Hari Bans Singh, learned counsel for the applicant, learned AGA for the State and considering the fact that the deceased died within six months of the marriage, she was also carrying pregnancy of two months; that in the dying declaration the allegation is against the mother- in-law, however, the deceased has also stated that other family members also used to support her in the torture being meted out to her.
Learned counsel for the applicant has relied upon the statement of some of the witnesses recorded during trial to establish that no demand of dowry was made.
I may record that this Court is not inclined to scan the evidence of the witnesses as the trial is going on. I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
However, it has been stated by the counsel for the applicant that the trial court be directed to conclude the trial as early as possible.
The trial court is directed to expedite the aforesaid trial and conclude the same expeditiously as early as possible.
