Heard learned counsel for the petitioner and perused the record.
By means of this petition under Article 227 of the Constitution of India, the petitioner has prayed for following relief:-
"(1) Issue an appropriate order or direction, directing the Civil Judge (Junior Division) Hathras District Hathras to decide the application bearing paper no.7C2 file under order-39 Rule-1 & 2 read be section 151 C.P.C. in Original Suit No.83 of 2021 (Smt. Bhagwan Devi Vs. Smt. Soniya and others), within stipulated period as this Hon'ble Court may deem fit and proper."
Considering overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid application of the petitioner filed in Original Suit No.- 83 of 2021, strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of six weeks from the date of production of copy of this order.
It is provided that a copy of the order available on the official website of the High Court will be taken to be authentic one.
