Heard Sri Sanjay Singh, learned counsel for the petitioner, Sri Ashish Mishra, learned counsel for the High Court and Sri Vikas Sahai, learned counsel for the C.B.I. and perused the record.
This writ petition has been filed with a prayer to direct the respondent no. 2 to submit his opinion in accordance with law within prescribed period.
Learned counsel for the High Court states that the petitioner was granted parole of two months in which he was released. Thereafter, petitioner has surrendered and he is in jail at the present moment which has not been disputed by the learned counsel for the petitioner.
Learned counsel for the petitioner submitted that the matter is still sub-judice for the opinion of the Competent Authority to which learned counsel for the High Court states that the guidelines have been framed and the petitioner has to furnish some details in pursuance of the said guidelines.
Taking into account the fact that the matter is still sub-judice for the opinion by the Competent Authority since 2016, Competent Authority is directed to consider the case of the petitioner and opine in accordance with law within eight weeks from the production of certified copy of this order.
With the aforesaid direction, writ petition is disposed of.
