1. Rule.
Learned Additional Public Prosecutor Mr. K.L. Pandya waives service on behalf of the State.
2. The applicant seeks temporary bail on the ground of his own treatment. On this very ground, he had earlier applied for temporary bail which application was entertained by this Court and he was released on bail. However, he met with an accident in which he came to be arrested and produced by the police before the jail authorities 12 days prior to the expiry of the bail period. This would indicate that this Court was satisfied that the cause for temporary bail was genuine. Somehow, he has not been able to get the treatment because of his involvement in the accident. In our view, this application, therefore, deserves to be allowed.
3. The application is accordingly allowed, in part. The applicant is ordered to be released on temporary bail for a period of 15 days from the date of his release, on his executing a personal bond of Rs.2,000/- before the Jail Authorities and on condition that he shall not leave the State and shall not indulge in any illegal activities during the period on which he is on temporary bail. The applicant shall surrender to the jail authorities, in time, on completion of the period of temporary bail. Rule is made absolute accordingly.
