Heard learned counsel for the petitioner and learned Standing counsel for the State-respondent.
The petition has been filed seeking the following relief-
"(I) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to take an appropriate decision upon the application of petitioner dated 14.04.2019 under Section 29/41 of U.P. L.R. Act with regard to establishing stone over the Gata No.429 area 0.024 hectare situated in village Sahatwar, Post- Sahatwar, District- Ballia within stipulated time."
Petitioner is aggrieved because the boundary marks erected on his application for demarcation, are alleged to be removed by the contesting respondent.
It is alleged that no action has been taken on his application for repair of these boundary marks.
The writ petition is, therefore, disposed of directing the respondent no.2, Sub Divisional Magistrate, Ballia, District Ballia to deal with the application filed by the petitioner for repair of the boundary marks, as expeditiously as possible.
