JUDGMENT / ORDER

(Order of the Court was made by The Hon'ble Chief Justice) On hearing the learned counsel for parties, it is agreed that the petitioner will file a fresh application before the Panchayat Council, Radhapuram (at present, the Commissioner) and a decision will be taken in respect of the same within a period of three (3) weeks from the date of the application. Needless to say that the consideration of the application will be as per the rules and regulations governing such application and as per the prevalent law. It is clarified at the request of the learned Senior Counsel for the petitioner that the Commissioner will independently apply his mind to the issue and may not be swayed down by the order passed by the Collector.
Writ petition is, accordingly, disposed of in the aforesaid terms. No costs.
