The petitioners, who got superannuated on attaining their age of superannuation, have filed this petition seeking salary for the period on which they admittedly did not work after superannuation. Learned counsel for the petitioners submit that due to the change in the academic sessions i.e. new session from 1st April to 31st March, any person retiring after 31st March was required to be taken back to complete the academic session upto 31st March. The petitioners, who got retired on 30th June, were not reemployed to complete the academic session upto 31st March 2017.
Learned counsel for the petitioners has failed to point out any material by which he can demonstrate that the petitioners had performed their duties and taught the students in the respective institutions. Admittedly the petitioners had not worked and they are seeking salary for the period for which they were not in employment after superannuation.
The petition, which has been filed seeking salary without work is not maintainable and, therefore, it is dismissed.
