Prayer in the present petition is to issue a direction to the Court below to expedite the proceedings of Matrimonial Petition No. 865 of 2014 (Basdev Vs. Smt. Anita) filed under Section 13 (1A-1B) of Hindu Marriage Act, 1955.
A perusal of the order-sheet indicates that the Court below has awarded a lump-sum amount pendente lite, towards cost of the suit to the wife.
The petitioner is not in a position to intimate as to whether he has tendered the said money to the wife to contest the suit.
Moreover, the order-sheet records that the suit is being proceeded for cross-examination of PW-2.
In view thereof, no positive direction can be given to the Court below to decide the divorce petition within the stipulated period. However, it is expected that the Court below shall make all endeavour to decide the matter expeditiously after satisfying itself that the money awarded by it vide order dated 13.09.2017 towards cost of the suit, had been paid by the plaintiff.
