Patel, learned counsel for the petitioners, relying on the decision in case of Pravinbhai Mohanbhai Raiyani & Ors. v. State of Gujarat & Ors., reported in 2007 (3) GLR 2606, submitted that the impugned action has been taken against the petitioner No.1 - committee / society for the defaults and irregularities allegedly committed by previous managing committee and therefore, the impugned action is unsustainable.
Notice returnable on 3.5.2012.
Mr.Patel, learned counsel for the petitioners has submitted that until now the proceedings before the competent authority has not proceeded further.
In that view of the matter, the petitioners are permitted to request the competent authority for adjournment in view of pendency of present petition.
