Criminal Misc. Bail Application No 327051 of 2014 Heard learned counsel for the applicant and learned A. G. A. for the State.
Applicant has moved the present bail application seeking bail in ST No.784 of 2010 arising out of case crime no.1117 of 2009 u/s 302/149 IPC PS Jhinjhana District Muzaffar Nagar.
We have perused the dying declaration of the deceased, contents of which are quiet explicit. No case for grant of any indulgence is made out.
Accordingly, the application for bail is rejected.
However, looking to the fact that the applicant is in jail for the last 9 years hearing of the appeal is expedited under Chapter-VIII Rule 33A of the Rules of Court.
Let the paper book be prepared within two months from today and thereafter appeal be listed for hearing before appropriate Bench.
