The petitioner claims benefit of 10% land in terms of the Full Bench decision rendered by this Court in Gajraj & Ors. Vs. State of U.P. and Ors. reported in 2011(11) ADJ 1.
This claim which can, in the first instance, be examined by the Chief Executive Officer, New Okhla Industrial Development Authority.
The petitioner may, if so advised, file a representation with a certified copy of the order passed by the Court.
Sri Kaushalendra Nath Singh, learned counsel appearing for Noida states that in case such a representation is filed, a decision shall be taken at an early date.
This writ petition is, accordingly, disposed of with a direction to the Chief Executive Officer, NOIDA that in case an application is filed by the petitioner for the aforesaid relief, the same shall be decided expeditiously and preferably within a period of six weeks from the date a certified copy of this order is filed by the petitioner.
It is made clear that the Court has not adjudicated the merits of the case and it will be for the Chief Executive Officer of NOIDA to examine the same in accordance with law.
