Mr KL Pandya learned APP waives service of rule on behalf of the State.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to make arrangements for the engagement of his daughter and wants to attend the ceremony of Shivratri.
It appears from the jail report that the convict has recently enjoyed furlough in November, 2011. The ground is not such where his presence can be said as indispensable.
Under the circumstances, the discretion does not deserve to be exercise and,therefore, the present application is not granted. Rule is discharged.
