The prayer made in the instant petition is for issuing direction to the trial court to decide Original Suit No.374 of 2004 within a specified time frame.
The petitioner initially succeeded in obtaining an exparte decree but the same has since been set aside on a restoration application filed by the defendants.
Having regard to the facts of the case and the submissions made, in instant petition is disposed of with direction to the trial court to make serious endeavour to decide the suit expeditiously by fixing short dates and without granting unnecessary adjournments to the parties.
