1. Present Special Civil Application is placed on Board by the Registry for extension of time to dispose of Misc.Application No.465 of 2011 by the concerned Magistrate i.e. learned Metropolitan Magistrate, Court No.8, Ahmedabad.
2. It is very unfortunate that despite the order passed by this Court, the learned Magistrate has not finally decided and disposed of the aforesaid Misc.Application No.465 of 2011. The explanation given by the learned In-charge Metropolitan Magistrate, Court No.8, Ahmedabad that the regular Presiding Officer was on leave and therefore, the aforesaid application could not be disposed of, cannot accepted. If the concerned Metropolitan Magistrate, Court No.8, Ahmedabad was on leave, it was the duty of the In-charge Metropolitan Magistrate who was in charge of the regular Metropolitan Magistrate, Court No.8, Ahmedabad, to hear the matter and finally decide and dispose of the application within stipulated time as directed by this Court. Under the circumstances, the action of the In-charge Metropolitan Magistrate, Court No.8, Ahmedabad in not complying with the directions issued by this Court amounts to disobeying the directions issued by this Court and the same is highly deprecated. The In-charge Metropolitan Magistrate, Court No.8, Ahmedabad is hereby directed to see that in future as and when any order is passed by this Court, he must comply with the same even if he may in -charge of the regular Court.
3. In the interest of justice, time to dispose of the Misc.Application No.465 of 2011 by the Metropolitan Magistrate, Court No.8, Ahmedabad is hereby extended upto 25/6/2012, if the said application is not decided and disposed of so far.
4. REGISTRY IS HEREBY DIRECTED send the writ of this order to the Metropolitan Magistrate, Court No.8, Ahmedabad, on or before 14/6/2012.
