Heard Shri Sujit Kumar Rai, learned counsel for the petitioner and the learned Standing Counsel on behalf of respondents no. 1 and 2.
In the present petition, the claim of the petitioner is that vide order dated 28.09.2017 the petitioner has been retired from service at the age of 60 years although his age of retirement is 62 years as per his appointment letter.
Counsel for the petitioner submits that the petitioner has preferred a representation before the respondent no. 2 (Joint Commissioner & Joint Registrar, Cooperative, Meerut Division, Meerut) under Section 128 of the Cooperative Societies Act, 1965 on 31.03.2018 (Annexure-5 to the writ petition), which is still pending.
No useful purpose would be served by keeping the writ petition pending.
Writ petition is accordingly disposed of with a direction to respondent no. 2 to decide the petitioner's representation dated 31.03.2018 in accordance with law preferably within a period of three months from the date of receipt of certified copy of this order.
