By way of filing this appeal under Section 173 of the Motor Vehicles Act, 1988 the appellant – insurance company has challenged interim award dated 30th June 2006 passed by the learned Motor Accidents Claims Tribunal (Aux), Gandhidham Kachchh below Exhibit 6 in MAC Petition No.266 of 2005 whereby the Tribunal has awarded interim compensation of Rs.50,000/- under Section 163A of the Motors Vehicle Act, 1988 on structured formula basis.
2 Though served, none appears for the claimants. This interim award may be treated as final award between the parties. The claimants therefore, would be entitled to Rs.50,000/- towards full and final compensation. Out of the aforesaid amount of compensation, 90% will be deposited in FDR and the remaining amount may be disbursed to the claimants, if not disbursed so far. This Court has not expressed any opinion on the merits.
This appeal stands disposed of. No order as to costs.
