Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State respondent no.1 and Sri Pranjal Mehrotra, learned counsel for respondent nos.2 to 4.
The petitioner has retired as Fitter from the office of respondent no.4, i.e., Executive Engineer, 3rd Construction Division, U.P. Jal Nigam, Ghazipur on 29.02.2020. The retiral dues of the petitioner, i.e., Gratuity, Earned Leave Encashment and arrears of dearness allowance have not been paid by the respondents- authorities and petitioner is running from pillar to post for his grievance before the authority concerned, i.e., respondent no.4.
The grievance of the petitioner is that respondent no.4 did not pay any heed on the request of the petitioner nor passed any order for payment of retiral dues.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.4 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.4- Executive Engineer, 3rd Construction Division, U.P. Jal Nigam, Ghazipur, along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case, any such representation is filed by the petitioner, the respondent no.4 shall decide the same by a reasoned and speaking order within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
