This petition for writ is preferred to have an appropriate writ, order or direction for "respondents/authority concerned to prevent from encroachment over Plot No.481 area 0.4570 hectare".
Suffice to mention that a suit in this regard is already pending before the competent Civil Court wherein an interim order too was passed directing the parties to maintain the status quo. In non-compliance of the interim order of the Civil Court an application under Order XXXIX Rule 2A of the Code of Civil Procedure, 1908 was filed, which is pending consideration before the civil court.
In view of the fact stated above, no interference in the matter is required under Article 226 of the Constitution of India.
The writ petition is dismissed.
The petitioner may pursue his cause under the application referred above pending before the Civil Court.
