Order on Civil Misc. Withdrawal Application No. 2 of 2018
Heard learned counsel for the parties and perused the record.
This withdrawal application has been filed stating the facts that in the present appeal, interim order dated 10.08.2016 has been passed by staying further proceedings before the court below. Subsequent to that, both the parties have settled their disputes outside of the court as is evident from notary affidavit dated 18.09.2018 (Annexure No. 1 to the affidavit). It is also stated in para no. 6 of the affidavit that the appellants have engaged and authorized to Sri Dwijendra Prasad, Advocate to file this withdrawal application in the appeal and the earlier counsel for the appellants has refuse to give no objection in the matter.
Learned counsel for the respondents, Sri Ajendra Kumar also verified the fact of compromise between the parties.
In view of the above, this withdrawal application is allowed.
Order on Appeal As the withdrawal application has already been allowed, consequently, the present appeal is also dismissed as withdrawn.
Interim order, if any, stands discharged.
