The petitioner is a Contractor and has done certain government work in 2008 and 2009, but the payment etc. has not been made which led to filing of Writ Petition No. 42149 of 2017 decided on 12.9.2017 issuing direction to the Executive Engineer to decide the representation of the petitioner. While deciding the representation dated 18.9.2017 the Executive Engineer has accepted the demand of the petitioner, but has shown his inability to pay due to lack of funds.
If the amount due to the petitioner is accepted by the respondents, the same has to be paid to the petitioner by the respondents who are government agencies.
The writ petition is disposed of with the direction to respondent no. 2 to ensure admitted amount of dues to the petitioner and pay the same without unnecessary delay, say as far as possible within four months from the date a certified copy of this order is presented before it.
