Learned APP, Mr.Pandya, waives service of Rule on behalf of respondent No.1 - State.
By this application, the applicant - convict prays that he be enlarged on temporary bail to attend the post death ceremony of his uncle, who has died on 18.4.2012.
From the jail remarks, we find that the applicant was already on temporary bail in the month of January,2012. Further Mr.Pandya, learned APP submitted that the furlough application of the applicant is already pending with the competent authority, which is submitted in February,2012. Under the circumstances, the competent authority is directed to decide the application for furlough which is pending before it, as expeditiously as possible, preferably within a period of 15 days from today.
Considering the totality of the facts, discretion does not deserve to be exercised. The application is rejected, subject to above direction. Rule is discharged.
