JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pandya, learned APP waives service of rule on behalf of the respondent-State.
The present application has been preferred by the applicant -convict for temporary bail on the ground that he wants to attend the post death ceremony of his father who has expired on 8.2.2012.
The death certificate is produced and the ground appears to be genuine.
Further, since the matter is pertaining riot cases, and in other riot cases, some of the convict were released on temporary bail are reported absconding, while releasing the other co-convict in riot cases (Godhra), this Court has put up the condition of police escort in order to ensure that the convict is again lodged with the jail authority. Hence, the appropriate conditions is required to be imposed.
Under the circumstances, the applicant be permitted to attend the post death ceremony of his father under the police escort of 1 ASI and 2 Armed Constables at his cost for a period of 3 days from actual release. It is further directed that after the amount of cost is deposited with the jail authority, the aforesaid order shall be implemented. It is also directed that it will be the duty of the Escorting Officer to see that upon the expiry of the period of 3 days, the convict is lodged with the jail authority well in time.
Application is disposed of accordingly. Rule made absolute. Direct service is permitted.
