Bachu vs State

High Court Of Gujarat|09 July, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. The present application is filed by the convict seeking temporary bail for a period of four weeks on the ground that he has to attend the marriage of his cousin.
2. Learned Advocate for the applicant seeks permission to amend the cause-title, as it is mentioned in the cause-title that 'the convict is on temporary bail at present.'
3. Learned APP Mr. Patel invited attention of this Court to jail remarks. It seems that the convict is more out of jail rather then inside the jail. In the year 2011, the convict was released on temporary bail on two occasions. Last he was out on temporary bail in the month of May-June, 2012 for a period of thirty days and he has also enjoyed three furlough's.
4. Taking into consideration the aforesaid facts, no case is made out and hence the application is rejected. The Registry is directed to send a copy of this application, to be kept in the history ticket of the present applicant - Bachu Harun Gandhar, by the jail authorities.
