1. Rule.
Ms. Hansa Punani, learned APP waives service of Rule for the State.
2. This application is filed with a prayer to suspend the condition no.5 imposed in order dated 26.7.2002 for a period of two months and direct the P.S.O., Wadi Police Station, Vadodara to hand over the passport to the applicant to enable him to go for religious tour.
3. In response to the notice issued on 2.7.2008, learned APP has inquired from Wadi Police Station, Vadodara City and submitted that as the applicant is praying for the release of the passport to go on a religious tour, they have no objection if the passport is handed over.
4. Heard the learned advocates. The order releasing the applicant on bail was passed on 26.7.2002 and it seems that till now, no untoward incident has taken place. Further, the applicant is asking for release of passport to go on a religious tour.
5. In view of the above, the applicant is permitted to go for religious tour for a period of one month from the date of release of the passport. The PSO, Wadi Polilce Station, Vadodara shall hand over the passport to the applicant on the following terms and conditions :
That he shall deposit Rs. 10,000/- in cash before the P.S.O., Wadi Police Station and he shall also give surety of like amount.
That he shall on completion of the tour return to India and surrender the passport back with the P.S.O., Wadi Police Station on or before 8th August, 2008.
On the applicant surrendering the passport, the P.S.O., Wadi Police Station shall return the amount of Rs.10,000/- deposited by the applicant.
6. This application is allowed. Rule is made absolute. Direct service is permitted today.
