1. Heard Sri S. B. Singh, learned counsel for the petitioner, learned Standing counsel for the State and Sri Aditya Bhushan Singhal for respondent No.s 2 and 3.
2. It has been submitted by learned counsel for the petitioner that the petitioner has been superannuated from the post of Chaukidar on 31.1.2019 from the office of Executive Engineer, IInd Prakalp Khand, U.P. Jal Nigam, Ballia and since then his leave encashment, gratuity and other post retiral dues have not been paid by the respondents and consequently seeks appropriate direction by means of the instant writ petition for consideration of his representation and payment of post retiral dues.
3. Learned counsel for the respondents do not object in case a direction is issued to the respondents to consider the claim of the petitioner expeditiously.
4. Accordingly, without entering into merits of the case, the present petition is disposed of with a direction to respondent No.3 to consider and decide the representation of the petitioner dated 6.11.2020, expeditiously, say within a period of three months from the date a copy of this order is placed before him. While considering the representation the respondent shall also consider payment of interest to the petitioner for the delayed payment in view of the decision of this Court in the case of Yogendra Singh Vs. State of U.P. (2017)1 ALJ 121.
