Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submits that the applicant is the sole earning member of his family; applicant is languishing in jail since 9.6.2017, hence the applicant may be released on bail.
It is urged by learned A.G.A. that the trial is at the stage of Section 313 Cr.P.C.; applicant is not cooperating with the trial; it is not in public interest to enlarge the applicant on bail at this stage.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant, Babaloo involved in Case Crime No. 73 of 2006, under section 364, 394, 302, 201 I.P.C. and 3(2)5 S.C./S.T. Act, P.S. Lodha, District Aligarh.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
