Heard Shri Sanjay Srivastava, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
Learned counsel for petitioner is permitted to make necessary correction in the petition during the course of the day.
This writ petition has been filed for issuing of mandamus directing the respondent no. 2 i.e. Station House Officer, Police Station- Collectorganj, District- Kanpur Nagar to ensure the fair and impartial investigation in pursuance of F.I.R. dated 21.09.2017 registered as Case Crime No. 131 of 2017, under Sections 406, 504 & 506 I.P.C., Police Station- Collectorganj, District- Kanpur Nagar.
It is alleged that F.I.R. was lodged on 21.09.2017 but police is not proceeding in the matter.
In the facts of present case, writ petition is disposed of with the direction to respondent no. 2 i.e. Station House Officer, Police Station- Collectorganj, District- Kanpur Nagar to ensure the fair and impartial investigation in pursuance of F.I.R. dated 21.09.2017 registered as Case Crime No. 131 of 2017, under Sections 406, 504 & 506 I.P.C., Police Station- Collectorganj, District- Kanpur Nagar and submission of report by Investigating Officer under Section 173(2) Cr.P.C. as early as possible.
