Ramachandran Nair, J. The petitioner, who is the father of Miss.Alka Baby, has sought for issuance of a Writ of Habeas Corpus directing respondents 1 to 4 to produce the body of his daughter and set her at liberty to the custody of the petitioner.
2. The allegation is that she is missing from 10.07.2014 and the 5th respondent has enticed her.
3. This Court passed an interim order on 21.07.2014 directing production of the girl before this Court on 29.07.2014 but she could not be traced out and subsequent orders have also been passed by this Court directing to take effective steps for tracing out the girl.
4. The 5th respondent is not appearing before this Court.
It is seen from the averments that he is a married man having a child aged 2. It is submitted by the learned counsel for the petitioner and the learned Senior Government Pleader that the girl has been traced out from Chennai and was produced before W.P.(Crl). No. 308 of 2014 2 the Judicial First Class Magistrate Court, Payyoli yesterday.
5. We have interacted with the girl and her father.
According to her, she wants to live with her father and continue her education.
6. Since she has expressed her will to leave with her father, we permit her to do so and we are satisfied that she is doing so on her free volition.
Accordingly, this writ petition is disposed of.
