JUDGMENT / ORDER

Though the petitioner is studying in the 3rd respondent College and undergoing B.E. Mechanical Engineering course, he was not allowed to write the 7th semester examination due to lack of attendance, i.e. minimum 75% attendance.
2. It is submitted by the learned counsel for the 3rd respondent College that the petitioner has secured only 57.94% attendance as against 75% and even if his absence is condoned, the minimum required attendance is 65%. Therefore, it is not possible for the respondents to allow the petitioner to write the examination and he has to re-do the 7th semester by attending the classes.
3. When the rules are very clear stating that requirement of 75% attendance is must for writing the examination, the same cannot be violated. Therefore, the relief sought for by the petitioner cannot be granted and the petitioner has to continue classes in the same semester and secure the minimum attendance required. Thereafter only, he could write the examination for the 7th semester. Hence, the writ petition fails.
4. In the result, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
