Heard Sri Arnab Banerji, learned counsel for the petitioner, Sri Pramod Kumar Bajpayee and Sri R.V. Pandey, learned counsel appearing for respondent no. 2.
The petitioner has preferred this petition for a direction to the respondent-bank to consider his One Time Settlement (OTS) offer dated 5.10.2018 within a time bound period. The petition reveals that in respect to the aforesaid offer, the bank has clearly intimated to the petitioner that the proposal is not acceptable as it is on a lower side whereupon the petitioner had taken time to revert back after a week so as to increase the offer. The said time has expired but probably the petitioner has not contacted the bank again in connection with the same.
In view of the facts and circumstances, we dispose of this petition with liberty to the petitioner to negotiate with respondent no. 2 on the aforesaid OTS dated 5.10.2018 whereupon the respondent no. 2 shall take a final decision and communicate it in writing to the petitioner.
The petitioner will appear before the respondent no. 2 within a period of ten days from today.
