Heard learned counsel for the petitioners and Sri Girish Kumar Srivastava, who has filed memo of appearance on behalf of respondent no. 1 to 3 which is taken on record.
By this petition under Art. 226 of the Constitution, the petitioners-institution seek a direction in the nature of mandamus commanding respondent no. 2 & 3 to consider the petitioners' application for grant of affiliation for running Private ITI course in Electrician and Fitter Trade, after due panel inspection as per the norms and guidelines, within some stipulated period.
Submission of the counsel for petitioners is that petitioners- institution want to establish a private ITI and start the training course in Electrician and Fitter Trade and for that purpose the petitioners-institution have sufficient infrastructure as per the prescribed norms and guidelines issued from time to time. It is further submitted that petitioners after satisfying the necessary standards, applied for recognition/affiliation in respect of the aforesaid courses on 29.6.2015 and 19.6.2015 vide annexure no. 1 & 2 respectively and have also deposited the requisite fee online but till date nothing has been done in the matter by the respondent-authorities.
Sri Girish Kumar Srivastava, representing the respondents submits that he has no objection in case suitable direction is issued to the respondent concerned for passing appropriate order on the petitioners' application.
In view of the above, this writ petition is being finally disposed of by issuing a direction to respondent no. 2 & 3 to consider the petitioners' application dated 29.6.2015 and 19.6.2015 appended as annexure no. 1 & 2 to the writ petition in accordance with law expeditiously preferably within a period of six months from the date of production of a certified copy of this order. No order as to costs.
