Ayesha Parveen Bijili vs S.I.Basheer Ahamed ... 1St

Madras High Court|09 June, 2017

JUDGMENT / ORDER

The petitioners seek transfer of Inam C.M.A.No.1 of 2007 pending on the file of the Principal Subordinate Judge ? cum ? Tribunal Constituted under Tamil Nadu Inam Supplementary Act, 31 of 1963, to some other Court.
2. Certain allegations have been made against the Presiding Officer. In view of the subsequent developments, I do not propose to go into the merits of those allegations made against the Presiding Officer.
3. The learned Principal Subordinate Judge is designated as the Presiding Officer of the Inam Tribunal. Because the Principal Subordinate Court was vacant, the matter was dealt with by the learned II Additional Subordinate Judge, Trichy, who was In-Charge of that Court.
4. Now, it is learnt that the learned I Additional Subordinate Judge is appointed and the appeal is being taken up by the learned I Additional Subordinate Judge, who is In-Charge of the Principal Subordinate Court, Trichy.
5. It is also brought to my knowledge by the Registry that the learned Principal Subordinate Judge has already been appointed and he is to take charge shortly.
6. Therefore, the grounds alleged in this petition for transfer do not survive. Hence, this Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, the connected civil miscellaneous petition is dismissed.
To
1.The Principal Subordinate Court, Trichy.
2.The II Additional Subordinate Court, Trichy.
3.The I Additional Subordinate Court, Trichy..
