Petitioner's father was working as a Supervisor in the Primary Health Centre run by the Medical Department of the State. He stated to have died in harness on 29.02.2012. Petitioner has moved an application for grant of compassionate appointment, which is remained pending.
Attention of this Court has been invited to a letter dated 09.11.2017; whereby, petitioner's claim has been forwarded to the Director General, Family Welfare, Lucknow. Since no decision has been taken, despite expiry of sufficient time, as such, petitioner is before this Court.
Learned standing counsel submits that petitioner's claim shall be considered by the authority concerned, in accordance with law.
In the facts and circumstances of the case, noticed above, this petition stands disposed of permitting the petitioner to approach respondent no. 3, along with a certified copy of this order, within a period of two weeks from today, annexing all materials in support of his claim. In case petitioner raises such a claim, his grievance, relating to compassionate appointment, would be examined in terms of the provisions contained in Dying in Harness Rules, 1974, within a further period of three months, thereafter.
