The instant application under section 482 Cr.P.C. has been filed for quashing of the summoning order dated 02.08.2018 passed in Session Trail No. 80 of 2018 (Raj Bahadur vs. Suresh and others) arises out of Complaint Case No. 218 of 2017, under Sections, 395, 397, 506 I.P.C., Police Station- Allau, District- Mainpuri, pending before the Special Judge (Dacoity Afected Area) District- Mainpuri as well as entire criminal proceeding of the said case.
Learned counsel for the applicants has made limited prayer that the applicant is willing and ready to appear before the court below as directed by this Hon'ble Court.
In view of the facts and circumstances of the case, this application is disposed of with direction that the applicants shall appear on or before 09.05.2019 before the court along with appropriate application and the court below is expected to decide the same at the earliest possible.
Till the disposal of the said application, the non bailable warrant shall be kept in abeyance.
The application U/s 482 Cr.P.C. is disposed of accordingly.
