Awanish Yadav vs State Of U P And Others

High Court Of Judicature at Allahabad|25 February, 2019

JUDGMENT / ORDER

Court No. - 6
Case :- WRIT - A No. - 2978 of 2019 Petitioner :- Awanish Yadav Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Surendra Kumar Counsel for Respondent :- C.S.C.,Ajay Kumar Giri
Hon'ble Yashwant Varma,J.
Heard learned counsel for the petitioner and the learned Standing Counsel for the State respondents.
This petition impugns an order dated 25 December 2018 pursuant to which the candidature of the petitioner as a Constable in the Police Force has been cancelled on the ground of concealment of material facts. Admittedly, on 22 May 2018, the petitioner furnished an Affidavit in which he stated that no case was registered against him nor was any investigation in connection with a criminal case pending against him. Upon verification however the respondents have found that the petitioner was named as an accused in a criminal case which was registered on 23 January 2018 as Case Crime No. 0011 of 2018. Despite repeated queries, learned counsel for the petitioner was unable to address any submission with respect to the backdrop in which not only were the details of this criminal case not disclosed but also wrong facts and assertions made in the Affidavit which was filed before the respondents.
Bearing in mind the aforesaid, the view taken by the respondents that the petitioner was unsuitable for appointment in the Police Force, merits no interference.
The petition is consequently dismissed.
Order Date :- 25.2.2019 Arun K. Singh (Yashwant Varma, J.)
