Heard Shri Shishir Kumar Tiwari, learned counsel for the applicant and learned A.G.A. for the State.
Present application under Section 482, Cr.P.C. has been filed for a direction to the Presiding Officer, Court No.3, Gautam Buddh Nagar to decide the complaint case No.109 of 2014 (now 089 of 2017) in CNR No.UPGB04060740-2016, under Section 138, Negotiable Instrument Act, P.S.Sector 39 Noida, District Gautam Buddh Nagar within the stipulated time.
The contention of learned counsel for the applicant is that the complaint is pending since 2014. Till date the accused failed to appear before the court below.
Under these circumstances direction is issued to the court concerned to ensure the presence of accused persons in accordance with law by taking appropriate proceeding against him and decide the case as expeditiously as possible without granting unnecessary or long adjournments to the parties concerned.
With the aforesaid direction, the application stands finally disposed of.
